In a 2-1 ruling, the appeals court said the lower court had violated the rights of the victim's brother, 

Young Lee, to participate in a crucial hearing. "Because the Circuit Court 

violated Mr. Lee's right to notice and his right to 

participate in the hearing on the State's motion to 

vacate ... this Court has the power and duty to remedy those violations, provided that

We can do this without infringing on Mr. Lee." Syed is entitled to be free from
